www.encouragetravel.com is a website operated by DRUGOY FLEET5 LTD, a company incorporated and registered in England and Wales with company number 13846252, and its registered office is 20-22 Wenlock Road, London, England, N1 7GU.
All tours are operated by DRUGOY FLEET5 LTD. By booking or participating in a tour and any related products or services with the DRUGOY FLEET5 LTD, you agree to these Terms & Conditions.

1. Your details

Any personal information that we collect about you will be handled in accordance with our Privacy Policy. For us to confirm your travel arrangements you must provide all requested details with the balance of the trip price. Necessary details vary by trip; they include but are not limited to full name as per passport, date of birth, nationality, passport number, passport issue and expiry date and any pre-existing medical conditions you have which may affect your ability to complete your travel arrangements. On some more demanding trips we also require you to complete and forward a Self-Assessment form which will be provided to you by your sales representative. 2. Deposit requirement

You are required to pay a non-refundable deposit for your booking to be confirmed. To secure a booking, we must receive payment of the minimum deposit of 10% of the total trip price, per person, (or full payment if booking within 60 days of the start of your trip or at an earlier stage for some trips).
A higher deposit will be payable if any supplier(s) requires additional payment at the time of booking / prior to balance due date. On occasions, full payment for a service such as your flights may be required at the time of booking. The applicable deposit will be confirmed at the time of booking.

3. Acceptance of booking and final payments

If we accept your booking, we will issue you with a booking confirmation invoice.  A contract will exist between you and us from the date we issue the confirmation. Please refer to your booking confirmation invoice for details regarding final payments. The balance of all monies due must be received by us or our authorised travel agent not later than 60 days before the start of your trip. For certain trips, full payment must be received sooner. We will tell you at the time of booking when this is the case. If this balance is not paid on or before the due date we reserve the right to treat your booking as cancelled and any cancellation charges outlined at clause 5 (Cancellation by You) will apply.
Deposit and balance payments must be made in the same currency and sufficient payment should be sent to ensure the company receives the total invoiced price as guaranteed.

4. If you change or transfer your booking

A confirmed group tour departure booking can be changed or transferred free of charge to a different departure date or trip, up to 60 days prior to departure, subject to the conditions below. A 50EUR per booking admin fee applies to any changes and transfers made to non-group self-guided holidays up to 60 days before departure. Thereafter all changes will be treated as cancellations and subject to the cancellation charges below.

Transfer of Booking:

If you or any member of your party is prevented from travelling, in circumstances which we consider reasonable, that person(s) may transfer their place to someone else, subject to the following conditions:
A. that person is introduced by you and satisfies all the conditions applicable to the holiday;
B. we are notified not less than 7 days before departure;
C. you pay any outstanding balance payment, an amendment fee of 50EUR per person transferring, as well as any additional fees, charges or other costs arising from the transfer. As most airlines do not permit name changes after tickets have been issued for any reason, these charges are likely to be the full cost of the flight / an alternative flight;
D. the transferee agrees to these booking conditions and all other terms of the contract between us.
You and the transferee remain jointly and severally liable for payment of all sums. If you are unable to find a replacement, cancellation charges as set out in clause 5 will apply in order to cover our estimated costs. Otherwise, no refunds will be given for passengers not travelling or for unused services

5. Cancellation by you

If you cancel some or all portions of your booking the cancellation terms set out below will apply.  A cancellation will only be effective when we receive written confirmation that you have sent to your relevant sales representative of the cancellation.
If you cancel a trip:
a) 60 and more days before trip start date – loss of deposit
b) 59-42 days before trip start date – 30% or loss of deposit if higher
c) 41-28 days before trip start date – 60%
d) 27-14 days before trip start date – 90%
e) Less than 14 days before trip start date – 100%

6. Cancellation by us

Our trips are guaranteed to depart once minimum group size is taken. Our managers will inform you about this moment.Except when Force Majeure (as defined in clause 24 Force Majeure) results in the cancellation of a trip, if we have to cancel your trip, we will tell you as soon as possible and if there is time to do so before departure, we will offer you the choice of:
(a) a 100% credit of monies paid for your trip; or
(b) having a refund of monies paid.
We will tell you the procedure for making your choice. Please read any notification carefully and respond promptly as if you do not respond to us within the timescale given your booking may be cancelled.
In the event of any cancellation, there will be no claim for damages by either party against the other and we are not responsible for any incidental expenses that you may have incurred as a result of your booking including but not limited to visas, vaccinations, travel insurance excess or non-refundable flights.

7. Age & Health requirements 

Minimum Age: You should check minimum age for each trip with our managers.  All travellers under the age of 18 must be accompanied by a legal guardian, or in lieu of a legal guardian, by an escort over the age of 18, appointed by their legal guardian.  The legal guardian or their designee will be responsible for the traveller under the age of 18’s day to day care. If a legal guardian elects to designate an escort in their lieu, they will be required to complete and sign a relevant document, to delegate their authority.
Maximum Age: For the majority of our trips we have no upper age limit though we remind you that our trips can be physically demanding and passengers must ensure that they are suitably fit to allow full participation.  We can provide details on mandatory health requirements; however, we are not medical experts. It is your responsibility to ensure that you obtain proper and detailed medical advice at least two months prior to travel for the latest health requirements and recommendations for your destination.

8. Passport and visas  

It is your responsibility to obtain information and to have in your possession all the required documentation and identification required for entry, departure and travel to each country or region you visit on your trip. This includes a valid passport and all travel documents required by us and/or the relevant governmental authorities including all visas, permits and certificates (including but not limited to vaccination or medical certificates) and insurance policies.
Any information we give about these matters or related items (climate, clothing, baggage, personal gear etc) is given in good faith but without responsibility on our part. We regret we cannot accept any liability if you are refused entry onto any transport or into any country due to failure on your part to carry all required documentation.
You agree that you are responsible for the full amount of any loss or expense incurred by us that is a direct result of your failure to secure or be in possession of proper travel documentation.

9. Travel insurance 

Travel insurance is mandatory for all our travellers and must be taken out at the time of booking.  Your travel insurance must provide cover against personal accident, death, medical expenses and emergency repatriation with a recommended minimum coverage of US$200,000 for each of the categories of cover. We also strongly recommend it covers cancellation, curtailment, personal liability and loss of luggage and personal effects. You must provide your travel insurance policy number and the insurance company's 24-hour emergency contact number on the first day of your trip; you will not be able to join the trip without these details.  If you have travel insurance connected to your credit card or bank account please ensure you have details of the participating insurer, the insurance policy number and emergency contact number with you rather than the bank's name and credit card details.

10. Change of itinerary

You appreciate and acknowledge that the nature of this type of travel requires considerable flexibility and you should allow for alternatives. The itinerary provided for each trip is representative of the types of activities contemplated, but it is understood that the route, schedules, itineraries, amenities and mode of transport may be subject to alteration without prior notice due to local circumstances or events.
While we endeavour to operate all trips as described we reserve the right to change the trip itinerary. Please refer to our website before departure for the most recent updates to your itinerary.
Before departure:  If we make a significant change, we will inform you as soon as reasonably possible if there is time before departure. The definition of a significant change is deemed to be a change which we can reasonably expect to have a major effect on your trip. When a significant change is made you may choose between accepting the changed trip; accepting an alternative trip if available and if offered by us (we will refund any price difference if the alternative tour is of a lower value), or having a refund of monies paid.
After departure:  We reserve the right to change an itinerary after departure due to local circumstances or events outside of our control. Where this occurs we will, if possible, make alternative arrangements for you at no extra charge. Please note we are not responsible for any incidental expenses that may be incurred as a result of any change in itineraries including but not limited to visas, vaccinations, non-refundable or non-changeable flights.
However, if a trip, including a guaranteed departure consists of a group size of 3 or less, we reserve the right to substitute your team leader with one or more local representatives and we may utilise public transport and/or taxis for the whole or part of your trip instead of the advertised trip vehicle. Where this is the case, we will tell you as soon as we are able. Any such change(s) will not be a significant change.
We appreciate that the group experience is important to many of our customers therefore in some cases where there is an opportunity to suggest an alternative departure date which affords you a wider group experience, we will offer a this as a no obligation alternative.

11. Authority on tour  

Our trips are run by a group leader. The decision of the group leader is final on all matters likely to affect the safety or well-being of any traveller or staff member participating in the trip. If you fail to comply with a decision made by a group leader or interfere with the well-being or mobility of the group, the group leader may direct you to leave the trip immediately, with no right of refund.  We may also elect not to carry you on any future trips booked. You must at all times comply with the laws, customs, foreign exchange and drug regulations of all countries visited.
If in the opinion of any such person(s) or any other person in a position of authority (such as, for example, an airline pilot or hotel manager), your health, level of fitness or conduct at any time before or during a trip is endangering or appears likely to endanger your health or wellbeing or any third party (including any other clients of the Company) or the safe, comfortable or happy progress of the trip, you may be excluded from all or part of the trip without refund or recompense.
Where you are excluded, we will have no further responsibility towards you (including any return travel arrangements) and we will not meet any expenses or costs incurred as a result of the exclusion. If you commit an illegal act (including, for example, causing any damage) you may be excluded from the trip and we shall cease to have responsibility to/for you as above. No refund will be given for any unused services.

12. Acceptance of risk 

You acknowledge that the nature of the trip may be adventurous and participation involves a degree of personal risk. You may be visiting places where the political, cultural and geographical attributes present dangers and physical challenges greater than those present in our daily lives.
You acknowledge that you are choosing to travel at a time where you may be exposed to the COVID-19 virus. We will take all reasonable steps to ensure your safety and may require you to follow additional safety protocols on your trip.
We use information from government foreign departments and reports from our own contacts in assessing whether the itinerary should operate. However, it is also your own responsibility to acquaint yourself with all relevant travel information, including applicable health risks, and the nature of your itinerary. You acknowledge that your decision to travel is made in light of consideration of this information and you accept that you are aware of the personal risks attendant upon such travel. To the fullest extent permitted by law, we accept no liability in relation to these additional risks.

13. Optional activities 

Optional activities not included in the trip price do not form part of the trip or this contract. You accept that any assistance, recommendations or advice, given by your group leader or local representative in arranging optional activities (including before or after a trip) does not render us liable for them in any way. The contract for the provision of that activity will be between you and the activity provider. 

14. Force majeure

Except where otherwise expressly stated in these Booking Conditions we will not be liable or pay you compensation if our contractual obligations to you are affected by “Force Majeure”. For the purposes of these Booking Conditions, Force Majeure means any event beyond our or our supplier’s control, the consequences of which could not have been avoided even if all reasonable measures had been taken.
Examples include warfare and acts of terrorism (and threat thereof), civil strife, significant risks to human health such as the outbreak of serious disease at the travel destination or natural disasters such as floods, earthquakes or weather conditions which make it impossible to travel safely to the travel destination or remain at the travel destination, any event which we or the supplier(s) of the service(s) in question could not, even with all due care, foresee or avoid.
These events can include, but are not limited to war, threat of war, civil strife terrorist activity and its consequences or the threat of such activity, riot,  the act of any government or other national or local authority including port or river authorities, industrial dispute, labour strikes, lock closure, natural or nuclear disaster, fire, chemical or biological disaster, and adverse weather conditions, epidemics and pandemics or other health emergency, unavoidable technical problems with transport and all similar events outside our or the supplier(s) concerned’s control. Advice from your national authority (for example, the Ministry of Foreign Affairs) to avoid or leave a particular country may constitute Force Majeure.

15. Prompt assistance 

If, whilst you are on the tour, you find yourself in difficulty for any reason, we will offer you such prompt assistance as is appropriate in the circumstances. In particular, we will provide you with appropriate information on health services, local authorities and consular assistance, and assistance with distance communications and finding alternative travel arrangements. Where you require the assistance which is not owing to any failure by us, our employees or sub-contractors we will not be liable for the costs of any alternative travel arrangements or other such assistance you require.
Any supplier, airline or another transport supplier may, however, pay for or provide refreshments and/or appropriate accommodation and you should make a claim directly to them. Subject to the other terms of these Booking Conditions, we will not be liable for any costs, fees or charges you incur in the above circumstances if you fail to obtain our prior authorisation before making your own travel arrangements. Furthermore, we reserve the right to charge you a fee for our assistance in the event that the difficulty is caused intentionally by you or a member of your party, or otherwise through your or your party’s negligence.

16. Applicable law 

The laws of the United Kingdom govern these Terms & Conditions to the fullest extent allowable. Nothing in these Terms & Conditions, including this clause 16, affects your rights as a consumer to rely on any applicable local laws.
